Peregrine — Supplemental Terms of Use

These Supplemental Terms of Use ("Terms") govern your use of the Peregrine dry-fire laser training app ("Peregrine" or "the app"). Peregrine is owned and operated by Tyler Beattie ("we," "us," or "our") in Austin, Texas, United States.
APPLE STANDARD EULA
These Terms supplement Apple's Standard EULA that applies to apps obtained through Apple's App Store. If a provision of Apple's Standard EULA must control, it controls to that extent.
Apple's Standard EULA does not govern a license you buy directly from peregrinedryfire.com. A direct purchase is governed by these Terms alone, and Apple is not a party to it.
ACCEPTANCE AND ELIGIBILITY
By downloading, installing, or using Peregrine, you agree to these Terms. If you do not agree, do not use the app.
You must be at least the age of majority where you live and legally permitted to possess and handle any firearm or training equipment you use with Peregrine. Complying with the laws, rules, and regulations that apply to you is your responsibility.
LICENSE
Subject to these Terms, Tyler Beattie grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use Peregrine on Apple-branded devices you own or control, solely for your own non-commercial dry-fire training.
Except where applicable law does not permit the restriction, you may not copy, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, reverse engineer, decompile, disassemble, circumvent a technical measure, or create derivative works from Peregrine or any part of it. You may not use Peregrine to provide services for others or make it available on a network for simultaneous use by multiple devices.
PURCHASES AND LICENSE KEYS
Peregrine is a free download from Apple's App Store, and its free tier is usable without any purchase. The full trainer can be unlocked in two ways. You can buy the unlock through Apple's App Store as an in-app purchase, where Apple handles the transaction, the receipt, and any refund. You can also buy a license directly from peregrinedryfire.com, where our payment processor handles the transaction and sends you a license key by email. Both grant the same license and unlock the same features. Buying through one path does not entitle you to a license through the other.
A license key unlocks Peregrine on one device at a time. Entering a key contacts our license service to record the activation, and that request is described in our Privacy Policy.
Your license moves with you. If you replace, reset, or stop using a device, release the license on that device first and your key will activate on the next one. If the device is lost, broken, or already gone, email support@peregrinedryfire.com and we will release it for you.
Your license key is personal to you. Do not publish, share, distribute, or resell it. We may deactivate a key that has been published, shared, distributed, or resold, and we may decline to issue a replacement.
REFUNDS AND CANCELLATION
Purchases made through Apple's App Store are refunded by Apple under Apple's policies. We cannot refund an App Store purchase; request it through Apple.
For a license bought directly from peregrinedryfire.com, email support@peregrinedryfire.com within 14 days of purchase and we will refund it. We may decline repeated refund requests from the same buyer, and we may decline a request where the license appears to have been shared or resold.
PROMOTIONAL AND MEDIA USE
Independent news reporting, commentary, criticism, and reviews need no permission from us. Before using the Peregrine name, logo, screenshots, recordings, or other app materials in a sponsored feature, paid promotion, affiliate campaign, commercial endorsement, or advertising, request written permission at support@peregrinedryfire.com. You may not state or imply that Peregrine or Tyler Beattie sponsors, endorses, partners with, or approves a creator, channel, website, product, or service without that permission.
OWNERSHIP AND INTELLECTUAL PROPERTY
Peregrine and its original software are proprietary to Tyler Beattie, including its source and object code, hit-detection and target-acquisition systems, scoring and measurement systems, user interface, original artwork and content, and the Peregrine name, logo, and other brand elements. All rights not expressly granted are reserved.
These Terms do not claim ownership of standardized, public-domain, licensed, or other third-party target layouts, fonts, materials, or marks. Their respective owners and licenses continue to apply.
DRY-FIRE SAFETY
Firearms and training devices can be dangerous. Peregrine is a training aid only. You alone are responsible for safe, lawful firearm handling and for your training environment.
Before every session, you must physically verify that the firearm chamber and magazine are clear, that no live ammunition is present in the training area, and that you are using the app only for dry-fire practice with an unloaded firearm and an appropriate training laser device. Never use Peregrine with live ammunition.
Do not handle or operate a firearm you are unfamiliar with. Learn its controls, its safety, and how it unloads before you dry fire with it. Peregrine prompts reloads and calls movement between shots, and a session is not the place to be discovering how a firearm works.
Always follow the four fundamental rules of firearm safety: treat every firearm as loaded, never point it at anything you are not willing to destroy, keep your finger off the trigger until you intend to fire, and be certain of your target and what is behind it. Dry-fire practice at home does not suspend the fourth rule; the wall behind your target is a room, a hallway, or a neighbor. Stop using Peregrine if you cannot follow these rules safely and lawfully.
NOT A SAFETY DEVICE OR PROFESSIONAL INSTRUCTION
Peregrine is not a safety device. It cannot detect, confirm, or verify whether a firearm is loaded or unloaded, and you must never rely on it for that purpose. Any prompt, score, timing result, target indication, or other feedback is training feedback only. Peregrine is not a substitute for professional instruction, range supervision, lawful judgment, or your own safety checks.
ASSUMPTION OF RISK
To the maximum extent permitted by law, you assume all risks of injury, death, or property damage arising from or related to your handling of a firearm, training laser, target, or other equipment while using Peregrine.
WARRANTY DISCLAIMER
Peregrine is provided "as is" and "as available." To the maximum extent permitted by law, Tyler Beattie disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted or error-free operation. We do not guarantee that laser detection, target acquisition, timing, scoring, or measurement will be accurate, complete, or suitable for a particular purpose.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Tyler Beattie will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for injury, death, property damage, lost profits, lost data, or loss of use, arising out of or related to Peregrine or these Terms.
To the maximum extent permitted by law, Tyler Beattie's total liability for all claims arising out of or related to Peregrine or these Terms will not exceed the greater of the amount you paid for Peregrine in the 12 months before the claim arose or US $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
SUPPORT AND EXTERNAL SERVICES
Peregrine may open an optional support form hosted by Tally in your browser. Tally and any email provider you choose are separate services governed by their own terms and privacy practices. You decide whether to submit a report or attachment. We do not guarantee support availability, response time, or resolution.
CHANGES, SUSPENSION, AND TERMINATION
We may update Peregrine or these Terms. Updated Terms take effect on the stated effective date, and if you continue to use Peregrine after that date you accept them to the extent permitted by law.
We may suspend or terminate the license granted by these Terms if you materially violate them. On termination, you must stop using Peregrine and delete copies in your control, except where applicable law provides otherwise.
GOVERNING LAW AND VENUE
Except to the extent consumer-protection law in your place of residence requires otherwise, Texas law governs these Terms and any dispute related to them, without regard to conflict-of-law rules. You and Tyler Beattie agree that the state or federal courts located in Travis County, Texas have exclusive jurisdiction over those disputes.
MISCELLANEOUS
If any provision of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign or transfer your rights under these Terms without our written consent. These Terms, together with Apple's Standard EULA where applicable, are the entire agreement between you and us about Peregrine.
